By accessing or using The Trellis Way (also referred to as "The Trellis Way Nutrition & Training Protocol"), including our website, mobile application, and all related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and The Trellis Way ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

The Trellis Way is a fitness and nutrition guidance platform that provides users with personalized meal plans, training programs, progress tracking tools, community features, and educational content related to health and wellness.

The Service is NOT a medical service and does NOT provide medical advice, diagnosis, or treatment. The content provided through the Service is for informational and educational purposes only and is not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

3. User Accounts and Responsibilities

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years of age, or at least 13 years of age with verifiable parental or guardian consent

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to a violation of these Terms.

4. Plans and Billing

The Trellis Way offers the following plans:

• Free Preview: Limited access at no cost, including the readiness assessment and Day 1 preview.
• Core Program: A one-time purchase providing full access to the complete 90-day program, including personalized meal plans, training programs, progress tracking, and support.
• Couple's Bundle: A one-time purchase providing access for two people.

All prices are in US dollars. Payment is processed at the time of purchase for one-time plans. You authorize us to charge your chosen payment method for all applicable fees.

We reserve the right to modify pricing at any time. Any price changes will apply to future purchases.

5. Cancellation and Refunds

One-Time Purchases: Due to the digital nature of the content provided, purchases are generally non-refundable. However, we offer a 14-day satisfaction guarantee from the date of purchase. If you are not satisfied with your purchase within this period, you may request a full refund by contacting us at support@thetrellisway.com.

Refund requests made after the 14-day period will be reviewed on a case-by-case basis at our sole discretion.

6. User-Generated Content and Content Ownership

The Service may allow you to post, submit, or share content, including but not limited to community posts, comments, photos, and progress updates ("User Content"). You retain ownership of your User Content, but by posting it on the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and improving the Service.

You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third-party rights or applicable laws.

All content provided by The Trellis Way, including but not limited to text, graphics, logos, meal plans, training programs, images, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

7. Prohibited Conduct

When using the Service, you agree not to:

• Violate any applicable laws, regulations, or these Terms
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Share, redistribute, or resell any content, meal plans, training programs, or other materials provided through the Service
• Use the Service to promote or sell products or services without our written consent
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
• Use automated means (bots, scrapers, spiders) to access or collect data from the Service
• Interfere with or disrupt the Service or the servers and networks that host the Service
• Share your account credentials with others or allow multiple individuals to use a single account
• Post misleading health claims or provide medical advice to other users within the community features

8. Health & Fitness Disclaimer

The content provided through the Service, including meal plans, training programs, and nutritional guidance, is intended for general informational purposes only and is not a substitute for professional medical advice.

You acknowledge and agree that:

• You should consult a physician or other qualified health care provider before starting any exercise or nutrition program, particularly if you have any pre-existing medical conditions or are taking any medications
• You participate in any exercise or nutrition program at your own risk
• Individual results may vary and are not guaranteed
• The Trellis Way is not responsible for any injuries, health issues, or adverse effects that may result from your use of the Service
• If you experience any pain, discomfort, dizziness, or other symptoms during exercise, you should stop immediately and seek medical attention

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE 90-DAY PROTOCOL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Trellis Way, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party, including intellectual property rights
• Any User Content you post or share through the Service
• Any injury or health issue resulting from your participation in exercise or nutrition programs accessed through the Service

11. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, provide additional notice (such as an in-app notification or email).

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the Service and close your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflicts of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee.

12a. International Users

If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with your local laws. We make no representation that the Service is available or appropriate for use in all locations. By accessing the Service from outside the United States, you consent to the transfer of your data to the United States and agree that these Terms shall be governed by the laws of the State of Tennessee.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
